Birthday & Event | T& C Waiver

All parents must read through the following terms and conditions before signing. Please be aware that once you have signed the waiver, you fully agree and understand the policies and procedures as a condition to your child being allowed to participate in Tuck & Tumble parties and/or events.

Assumption of Risk: I understand and acknowledge that participation in tumbling, open gym activities, birthday parties, parent’s night out, private rentals and the use of all tumbling equipment (including but not limited to spring floors, mats, trampolines, and related apparatus) involves inherent and unavoidable risks.

These risks include, but are not limited to, slips, falls, collisions, overexertion, strains, sprains, broken bones, head injuries, paralysis, or other serious bodily injury or death. I voluntarily choose to allow participation and assume all risks, both known and unknown, associated with the birthday party and use of the Tuck and Tumble facility.

Release and Waiver of Liability (Including Negligence: On behalf of myself, my minor child(ren), all birthday party guests, and their respective parents or legal guardians, I hereby release, waive, and discharge Tuck and Tumble, its owners, officers, employees, instructors, volunteers, agents, and affiliates from any and all claims, demands, causes of action, or liability arising out of or related to any injury, illness, loss, or damage sustained during or as a result of participation in the birthday party or use of the facility, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF TUCK AND TUMBLE, to the fullest extent permitted under Arizona law.

Responsibility for Birthday Party Guests: I acknowledge and agree that as the birthday host and legal guardian, I am responsible for:

  • Informing all guests and their parents or legal guardians of the risks associated with participation

  • Ensuring that all guests follow Tuck and Tumble rules, safety guidelines, and staff instructions

  • Supervising guests as required and ensuring appropriate behavior at all times

I understand that each guest may be required to have an individual waiver on file, and that Tuck and Tumble reserves the right to deny participation to anyone without a properly executed waiver.

Medical Authorization: In the event of an accident or emergency, I authorize Tuck and Tumble to seek emergency medical treatment for myself, my child(ren), or guests if I cannot be reached. I agree to assume full financial responsibility for any medical treatment provided.

Indemnification & Hold Harmless Agreement: I agree to indemnify, defend, and hold harmless Tuck and Tumble from any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising from the participation or conduct of myself, my child(ren), or any birthday party guest.
